Elected Procedure Clause Samples
The Elected Procedure clause defines the specific process or method that parties agree to use for resolving disputes or handling certain contractual matters. This could involve choosing arbitration over litigation, selecting a particular set of rules, or designating a forum for dispute resolution. By clearly specifying the agreed-upon procedure, the clause helps prevent confusion or disagreement about how issues will be addressed, ensuring a smoother and more predictable resolution process.
Elected Procedure. An employee shall be deemed to have exercised his or her option under this section at such time as the employee timely files either a formal complaint of discrimination, an MSPB appeal, or a grievance in writing in accordance with the provisions of this Agreement.
