Common use of Effectiveness Conditions Clause in Contracts

Effectiveness Conditions. This Amendment shall become effective upon (a) the execution by Borrower and Lender of this Amendment, (b) delivery of same to Lender and (c) payment by Borrower of all of Lender’s costs and expenses (including reasonable attorney fees) incurred in connection with the preparation of this Amendment.

Effectiveness Conditions. This Amendment shall become effective upon the following: (a) the execution Execution and delivery by Borrower and Lender of this Amendment, Amendment to Bank; (b) delivery of same to Lender and (c) payment Payment by Borrower of all of LenderBank’s costs reasonable legal and other fees, commissions, costs, charges, taxes and other expenses (including reasonable attorney fees) incurred by Bank in connection with the preparation preparation, execution and delivery of this AmendmentAmendment and the fees and disbursements of Bank’s counsel and all recording fees; (c) Delivery of authorizing resolutions on behalf of Borrower; and (d) Delivery of other items as Bank shall reasonably request.
