Common use of Earned PSUs Clause in Contracts

Earned PSUs. The PSUs shall become “Earned PSUs” following the end of the Performance Period (as defined in Exhibit A) to the extent earned in accordance with the performance criteria set forth on Exhibit A (the “Performance Criteria”), based on the Administrator’s determination, in its sole discretion, of the level of achievement of the Performance Criteria.

Earned PSUs. The PSUs shall become “Earned PSUs” following the end of the Performance Period (as such term is defined in Exhibit AA hereto) to the extent earned in accordance with the performance criteria objectives set forth on Exhibit A (the “Performance CriteriaObjectives”), based on subject to the Administrator’s determinationCompensation Committee determining, in its sole discretion, of the level of achievement of the applicable Performance CriteriaObjectives.

Earned PSUs. The PSUs shall become “Earned PSUs” following the end of the Performance Period (as such term is defined in Exhibit AA hereto) to the extent earned in accordance with the performance criteria objectives set forth on Exhibit A (the “Performance CriteriaObjectives”), based on the Administrator’s determination, in its sole discretion, of the level of achievement of the Performance Criteriaapplicable performance objectives.
