Common use of Drilling Clause in Contracts

Drilling. OPERATOR shall have all drilling operations conducted by qualified and responsible independent contractors under competitive contracts. However, OPERATOR may employ its equipment and personnel in the conduct of such operations, but its charges therefor shall not exceed the then prevailing rates in the area and such work shall be performed pursuant to a written agreement among the PARTICIPATING PARTIES.

OPERATOR Operator shall have all drilling operations including mobilization and demobilization, conducted by qualified and responsible independent contractors under competitive contractscontracts then prevailing. However, OPERATOR Operator may employ its own equipment and personnel in the conduct of such operations, but its charges therefor shall not exceed the then prevailing rates in the area and such work shall be performed by Operator acting as an independent contractor under a written contract containing the terms and conditions and at rates as are customary and then prevailing in competitive contracts of independent contractors who are doing work of a similar nature and pursuant to a written agreement among the PARTICIPATING PARTIESParticipating Parties.
