Common use of Draft Application Clause in Contracts

Draft Application. At the last scheduled weekly meeting of each month (or, if there are no such meetings. no later than the 25th of each month), the Contractor shall submit to the District a report on the current status of the Work as compared to the Progress Schedule and a draft itemized application for payment for Work performed during the prior calendar month. This shall not constitute a payment request The Contractor, the District and the A/E shall meet prior to the last working day of the month and confer regarding the current progress of the Work and the amount of payment to which the Contractor is entitled. The District may request the Contractor to provide data substantiating the Contractor’s right to payment such as copies of requisitions or invoices from Subcontractors. The Contractor shall not be entitled to make a payment request, nor is any payment due The Contractor, until such data is furnished.
