Common use of Documentary References Clause in Contracts

Documentary References. Any reference herein to any instrument, document or agreement, by whatever terminology used, shall be deemed to include any and all amendments, modifications, supplements, extensions, renewals, substitutions or replacements thereof as the context may require. Notwithstanding the foregoing, as used herein "Certificate of Designation", "Convertible Preferred Stock", "Securities Purchase Agreement" and "Warrants" shall mean and refer only to such instruments as in effect on January 26, 1999, together with any amendments thereto or modifications thereof that have been approved in writing by Requisite Lenders.
