Common use of Divorce or Legal Separation Clause in Contracts

Divorce or Legal Separation. The Code provides that the transfer of your interest in a Xxxx XXX to your spouse or a former spouse under a divorce or separate maintenance decree or a written instrument incident to such decree is not considered a taxable transfer. After the transfer, the Xxxx XXX will be treated as maintained for the benefit of such spouse or former spouse. To effect such a transfer, you must provide the Custodian with a letter of instruction and the account number of the Xxxx XXX maintained by the spouse or former spouse.
