Common use of Distribution of Free Writing Prospectuses Clause in Contracts

Distribution of Free Writing Prospectuses. Each Agent covenants and agrees that it will not distribute any Free Writing Prospectus used or referred to by such Agent in a manner reasonably designed to lead to its broad unrestricted dissemination; provided, that such covenant and agreement shall not apply to any such Free Writing Prospectus forming part of the Time of Sale Prospectus or any such Free Writing Prospectus approved by the Company for broad unrestricted dissemination (such consent not to be unreasonably withheld).
