DISTANCE LEARNING PROGRAM. It is agreed between the ▇▇▇▇▇ Central School District and the ▇▇▇▇▇ Central Teachers’ Association that the following principles will be complied with as long as the Distance Learning Program (DLP) is offered or until changed by mutual agreement of the parties pursuant to the provisions contained herein. 1. The purpose of the DLP is to expand educational and vocational opportunities to students utilizing the latest telecommunication equipment available to our District. 2. The Distance Learning Program will be taught by qualified and certified people. The Distance Learning Program instructors shall be trained in the use of distance video learning technology. 3. Although the District shall determine the staffing needs as it currently does with the presentation of all instructional programs, the DLP shall not be the reason for a reduction of a staff member from full-time employee to part-time employee. 4. The District shall first solicit bargaining unit members for assignment purposes with respect to Distance Learning. In the event that no bargaining unit members are interested or volunteer for such assignment, the District may look outside the Association for people to perform Distance Learning assignments. 5. Teachers that participate in the DLP, who are covered under the collective bargaining agreement, shall continue to be covered by the benefits that are presently provided therein. This agreement shall not be interpreted or applied to deprive teachers of the professional advantages heretofore enjoyed. 6. The District will organize the Distance Learning Program so that it will have as minimal effect as possible on the general overall operation of the instructional schedule. 7. Teachers participating in the DLP shall be evaluated in the same manner as all other unit members, in accordance with the collective bargaining agreement. 8. Taping for the purpose of instruction and evaluation will be through the mutual consent of the teacher and the District. Such tapes, if any, will not be used without mutual agreement. 9. It is the intention of the District that DLP class sizes fall within the range of sound educational practices. 10. In the event that the Distance Learning Program is transmitted over public cable television, the District will meet with the instructor to discuss the need and ability to scramble the signal. 11. The grading of the Distance Learning students shall be the responsibility of the instructor in the transmitting District, and consistent with course requirements as determined by the curriculum guidelines. 12. Supervision of the students will be the responsibility of each Distance Learning site. 13. Compensation to ▇▇▇▇▇ bargaining unit members will be made pursuant to the ▇▇▇▇▇ collective bargaining agreement. 14. The District will make every effort to provide the instructor with (3) planning periods per six (6) day cycle. The District and Association shall establish a committee to review and amend the provisions contained herein when and if necessary. The committee shall be established no later than January 15, 2002, and shall consist of two members designated by the Association, and two members designated by the Board of Education. This memorandum of agreement may only be modified by the usual ratification procedures of the District and the Association.

Any alleged violation of these principles will be subject to the provisions contained hereingrievance procedure incorporated within the collective bargaining agreement between the parties.
1. A. The purpose of the DLP program is to expand educational provide courses that would not be available to the student(s) at the receiving school.
B. Distance Learning courses shall be taught by teachers certified in the subject area they will be teaching and vocational opportunities to students trained in the presentation utilizing the latest telecommunication equipment available to our Districttechnology.
C. Use of the Distance Learning Program shall not result in:
1. Reduction in the number of FTE positions.
2. The Distance Learning Program will be taught by qualified and certified people. reduction of staff in the unit from full time to part time.
D. The Distance Learning Program instructors teaching of DLP courses shall be trained in the use of distance video learning technologystrictly voluntary.

All conditions of employment, including teaching hours, extra compensation for work outside regular teaching hours, preparation periods, leaves and general working conditions shall be covered by maintained at not less than the benefits that are presently provided thereinminimum standards in effect in the district at the time this agreement is signed. This agreement shall not be interpreted or applied to deprive teachers of the professional advantages advantage heretofore enjoyed.
6F. The Distance Learning course shall not adversely affect the preparation or work load of the remainder of the unit members. The District will organize the Distance Learning Program instruction, transmission and receiving of a DLP course shall be scheduled so that it will have as minimal effect as possible on shall not significantly fragment adjacent class periods in which DLP students are enrolled. DLP classes shall be scheduled during the general overall operation of the instructional scheduleregular school day.
7. G. Teachers participating in the DLP shall be evaluated in the same manner as all other unit members, in accordance with the collective bargaining agreement. It is agreed that no such evaluations shall be placed in the teacher's permanent file without their permission.
8. Taping for the purpose of instruction and evaluation H. No class will be through taped without the mutual prior knowledge and consent of the teacher and the Districtteacher. Such tapes, if any, will not shall remain the joint property of the teacher and the district and shall be used without only with the mutual agreementconsent of both parties.
9. I. It is the intention of the District district that DLP class sizes size will fall within the range of sound educational practicespractices and the guidelines established by the SAN distance learning reference manual. Class enrollment limit will be at the discretion of the instructor in consultation with the Jr./Sr. High School Principal and will be determined prior to the scheduling of the DLP class.
10. J. In the event that the Distance Learning Program DLP is transmitted over public access cable television, the District will meet with transmitted program shall broadcast using a scrambled signal and the instructor to discuss the need and ability to scramble the signalreceiving district shall use a descrambler for instructional purposes.
11. K. The grading of the Distance Learning students DLP student participants shall be the responsibility domain of the instructor instructor.
L. The receiving district shall assume the full responsibility and liability for the supervision and maintenance of discipline of their students. No student shall be unattended at any time; a teacher or teacher assistant shall be present during the instruction in the transmitting District, and consistent with course requirements as determined by the curriculum guidelinesreceiving classroom.
12. Supervision of M. If a teacher at the students receiving site is given any responsibility, it will be the responsibility of each Distance Learning sitecounted as a class assignment and additional prep.
13N. DLP course instruction shall be compensated as follows:
1. Compensation Unit members teaching a course through the DLP shall receive an annual additional stipend equal to ▇▇▇▇▇ the rate established in the collective bargaining agreement for additional preps. (Article XIII; Section I.)
2. Unit members teaching an Advanced Placement course through the DLP shall receive an annual additional stipend equal to $2000.
3. If a DLP course is a new course offering, the bargaining unit members will be made pursuant to member shall receive an additional stipend for curriculum development at the ▇▇▇▇▇ rate established in the collective bargaining agreement.
144. If a teacher is required to attend conferences and/or training during the time school is not in session they will be compensated in accordance with the collective bargaining agreement (Article XIII; Section N.).
O. An Instructional Planning Committee (IPC) consisting of the Jr./Sr. High School Principal, a designee of the superintendent, a designee of the association is hereby recognized. The District will make every effort to provide the instructor with (3) planning periods per six (6) day cycleIPC shall reach its decisions by consensus. The District IPC's function shall be to consider all matters pertaining to the academic program which arises out of the use of the DLP. Where such issues involve matters pertaining to the collective bargaining agreement, the IPC's recommendations for resolving the matter will be made to both the Superintendent and Association shall establish a committee to review and amend the provisions contained herein when and if necessaryPresident. The committee IPC shall have no power to amend or otherwise alter the collective bargaining agreement.
P. An on-site person will be established no later than January 15designated and available for equipment, 2002, and shall consist of two members designated by transmission or related technical problems associated with the Association, and two members designated by the Board of Education. This memorandum of agreement may only be modified by the usual ratification procedures of the District and the AssociationDLP.
