Dispatch of Offers Sample Clauses

Dispatch of Offers. (a) IOH agrees that the Offers and accompanying documents to be sent by BC Iron under item 6 of section 633(1) of the Corporations Act may be sent on a date nominated by BC Iron that is earlier than the date prescribed by item 6 of section 633(1) of the Corporations Act. (b) Each party agrees to use best endeavours to implement the Takeover Bid in accordance with the Timetable. (c) Provided that a Superior Proposal has not been received by IOH in the interim, each party agrees to use reasonable endeavours to send the Bidder’s Statement and Target’s Statement to Shareholders together.
