Common use of Disclosure Excepted Clause in Contracts

Disclosure Excepted. If Xxxxxx was a mortgagee or a successor in interest to the mortgagee's secured position or a beneficiary under a deed in trust who has acquired the real property by deed in lieu of foreclosure, consent judgment or judicial deed issued pursuant to a foreclosure sale, or if Seller succeeded to the benefit of the § 77/15(2) exception, under 12 U.S.C. § 1821(d)(2)(A)(i) as set forth in Section 8.1 above, then Seller will NOT be providing the Illinois “Residential Real Property Disclosure Report” required by the Residential Real Property Disclosure Act but for the § 77/15(2) exception.
