Disclaimer, Expiry. 4.3.1 Except as specified in this section 4, Hardware are provided “as is” and in addition to any other disclaimers Ingy hereby disclaims to the extent allowed by applicable law all express or implied conditions, representations, and warranties relating to the Hardware, including, without limitation, any implied warranty or condition of merchantability, fitness for a particular purpose, noninfringement of third party rights, satisfactory quality, or arising from a course of dealing, law, usage, or trade practice. To the extent any such warranty cannot be disclaimed, such warranty is limited in duration to the applicable warranty period. Ingy shall take every due care with regard to Client data contained in Hardware, but is never obliged to recover damaged or lost data as a result of issues, failures, repairs and/or maintenance. 4.3.2 Claims against ▇▇▇▇ are extinguished after expiry of the period of limitation (verjaringstermijn) of one (1) year after the Client has, or should reasonably have, discovered the cause of the damages.
