Common use of Discharge of Liens and Encumbrances Clause in Contracts

Discharge of Liens and Encumbrances. (a) The Company, throughout the Lease Term, shall not permit or create or suffer to be permitted or created any Lien, except for Permitted Encumbrances, upon the Facility or any part thereof by reason of any labor, services or materials rendered or supplied or claimed to be rendered or supplied with respect to the Facility or any part thereof.

(a) The Company, throughout the Lease Term, shall not permit or create or suffer to be permitted or created any Lien, except for Permitted Encumbrances, upon the Facility or any part thereof thereof, without the Agency’s consent, including without limitation, by reason of any labor, services or materials rendered or supplied or claimed to be rendered or supplied with respect to the Facility or any part thereof.

(a) The Company, throughout the Lease Term, Company shall not permit or create or suffer to be permitted or created any Lien, except for Permitted Encumbrances, lien upon the Facility or any part thereof by reason of any labor, services or materials rendered or supplied or claimed to be rendered or supplied with respect to the Facility or any part thereofthereof except any liens existing on the date hereof This provision shall not prohibit the Approved Liens as they are defined in Section 6.1(a) hereof.

(a) The Company, throughout the Lease Term, shall not permit or create or suffer to be permitted or created any Lien, except for Permitted Encumbrances, upon the Facility or any part thereof by reason of any labor, services or materials rendered or supplied or claimed to be rendered or supplied with respect to the Facility or any part thereof. Mechanics' Liens shall be discharged or bonded within sixty (60) days of the filing or perfection thereof.
