Development Scheduling Sample Clauses

Development Scheduling. Developer shall have no obligation to initiate or complete development of any aspect of the New Projects within any period of time. Because the California Supreme Court held in ▇▇▇▇▇▇ Construction Co. v. City of Camarillo, 37 Cal.3d 465 (1984), that failure of the parties to provide for the timing of development resulting in a later adopted initiative restricting the timing of development to prevail over such parties’ agreement, it is the City’s and Developer’s intent here to cure that deficiency by acknowledging and providing that Developer shall have the right (without obligation), subject to the provision of this Agreement, to complete the New Projects in such order and at such rate and at such times as Developer deems appropriate within the exercise of their subjective business judgment.
