The "Determining Vacancies" clause defines the process and criteria for identifying when a position, office, or unit is considered unoccupied or available. Typically, this clause outlines the specific events or conditions—such as resignation, removal, death, or failure to accept an appointment—that result in a vacancy. It may also specify who is responsible for making the determination and the timeline for doing so. The core function of this clause is to ensure clarity and consistency in recognizing vacancies, thereby facilitating timely appointments or elections to fill open positions and maintaining organizational continuity.
Determining Vacancies. Where:
(i) A permanent vacancy exists; or
(ii) A new position is created; or
(iii) A Long Assignment is created and the Employer determines that the position is to be filled, subject first to the overriding duty to accommodate disabled Nurses and then any recall rights under Article 32, a notice shall be posted.
Determining Vacancies. 24-1.01 All staffing requirements and vacancies will be determined by the Company.

12.01 When the Employer determines that a vacancy is to be filled, notices shall be posted for a period of ten (10) calendar days at all sites throughout the Bargaining Unit. The length of posting for a Nurse Practitioner may be extended at the discretion of the Employer. A copy of the notice shall also be provided to the Union Co-Chair of the Bargaining Unit Grievance and Labour Management Committee or designate.
12.02 The Employer has the right to fill any vacancy on a temporary basis until the posting procedure outlined in Article(s) 12.00 through to 12.09, has been fulfilled.
Determining Vacancies. The District shall have the sole authority to determine when there is a vacant position.

(iii) A temporary vacancy exists of eight (8) weeks or more and the Employer determines that the position is to be filled, subject first to any overriding legal requirements and any recall rights under Article 11, a notice shall be posted.
(b) Should any Temporary Position subsequently become a permanent position, it shall be posted in accordance with this Article.
