Designation of DRE Concurrent with Any Affirmative Determination Clause Samples

The "Designation of DRE Concurrent with Any Affirmative Determination" clause establishes that a Designated Responsible Entity (DRE) must be appointed at the same time as any affirmative decision or determination is made under the agreement. The Secretary may designate Interior as the DRE, unless the Secretary, in his sole judgment and discretion, designates a non- Federal entity as the DRE consistent with Section 3.3.4.
