Design Four Sample Clauses

Design Four. Both CLEC and SBC ILLINOIS each provide two fibers between their locations. This design may only be considered where existing fibers are available and there is a mutual benefit to both Parties. SBC ILLINOIS will provide the fibers associated with the “working” side of the system. CLEC will provide the fibers associated with the “protection” side of the system. The Parties will work cooperatively to terminate each other’s fiber in order to provision this joint point- to-point linear chain SONET system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. The POI will be defined as being at the SBC ILLINOIS location.
Design Four. Both CLEC and Qwest each provide two (2) fibers between their locations. This design may be considered where existing fibers are available near each Party’s location. Both CLEC and Qwest will provide fiber cable to the last entrance manhole (unless both Parties designate otherwise) at the other’s respective location. Both CLEC and Qwest will provide a sufficient length of optical fire resistant cable for the other to run the fiber cable from the manhole and terminate on each Party’s respective fiber distribution frame in each Party’s respective location. Each Party shall deliver and maintain such strands wholly at its own expense up to the POI. Each Party shall take the fiber from the manhole and terminate it inside each Party’s respective office on the Fiber Distribution Frame (FDF) at each Party’s respective expense. Both Parties will work cooperatively to terminate each other’s fiber in order to provision this joint point-to-point SONET system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation.
Design Four. Upon mutual agreement of the Parties, both Charter and CenturyTel may each provide two fibers between their respective locations. This design may only be considered where existing fibers are Currently Available and there is a mutual benefit to both Parties. ILEC will establish, deploy, maintain, and assume responsibility for the fibers associated with the “working” side of the system. Charter will establish, deploy, maintain, and assume responsibility for the fibers associated with the “protection” side of the system. The Parties will work cooperatively to terminate each other’s fiber in order to provision this joint SONET ring, or point- to-point linear system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. For purposes of this fiber meet design option, the POI will be defined as located at the POI location established by the Parties pursuant to this Section 2 of Article V. Notwithstanding the Parties’ decision to define the POI in the manner described above, the Parties agree that each Party will be solely responsible for all of the deployment and ongoing maintenance costs associated with the fibers that it establishes and deploys under this design option.

Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. The POI will be defined as being at the SBC-AMERITECH location.

This design may only be considered where existing fibers are available and there is a mutual benefit to both Parties. AT&T 4-STATE will provide the fibers associated with the “working” side of the system. CLEC will provide the fibers associated with the “protection” side of the system. The Parties will work cooperatively to terminate each other’s fiber in order to provision this joint point-to-point linear chain SONET system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. The POI will be defined as being at the AT&T 4- STATE location.
Design Four. Both LEVEL 3 and TDS TELECOM each provide two fibers between their locations. This design may only be considered where existing fibers are available and there is a mutual benefit to both Parties. TDS TELECOM will provide the fibers associated with the “working” side of the system. LEVEL 3 will provide the fibers associated with the “protection” side of the system. The Parties will work cooperatively to terminate each other’s fiber in order to provision this joint SONET ring or point- to-point linear system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. The POI will be defined as being at the TDS TELECOM location.
Design Four. Upon mutual agreement of the Parties, both TWCIS (AL) and CenturyLink may each provide two fibers between their respective locations. This design may only be considered where existing fibers are Currently Available and there is a mutual benefit to both Parties. ILEC will establish, deploy, maintain, and assume responsibility for the fibers associated with the “working” side of the system. TWCIS (AL) will establish, deploy, maintain, and assume responsibility for the fibers associated with the “protection” side of the system. The Parties will work cooperatively to terminate each other’s fiber in order to provision this joint SONET ring, or point- to-point linear system. Both Parties will work cooperatively to determine the appropriate technical handoff for purposes of demarcation and fault isolation. For purposes of this fiber meet design option, the POI will be defined as located at the ILEC’s switch location. The Parties agree that each Party will be solely responsible for all of the deployment and ongoing maintenance costs associated with the fibers that it establishes and deploys under this design option.
