Design Certification. Without limiting the Consultant's obligations under the Contract or otherwise at law or in equity, the Consultant must, with each submission of Design Documentation under clause 6.2, payment claim under clause 11.2 and prior to Completion (as defined in the Construction Contract) provide the Contract Administrator with: a certificate in the form of the Consultant Design Certificate which certifies that (to the extent then applicable): the Design Documentation complies with: subject to clause 2.10(a)(i), all Statutory Requirements (including the WHS Legislation); and the requirements of the Contract; and the Works comply or the Stage (as defined in the Construction Contract) complies with the Design Documentation which has not been rejected by the Contract Administrator under clause 6.3; and a corresponding certificate from each subconsultant that performs design work as part of the Services in the form of the Subconsultant Design Certificate which certifies that (to the extent then applicable): all design carried out by that subconsultant complies with: subject to the subcontract, all Statutory Requirements (including the WHS Legislation); and the requirements of the subcontract; and the Works comply or the Stage (as defined in the Construction Contract) complies with the design carried out by that subconsultant, except to the extent set out in such certificates.

Design Certification.
