Common use of Delivery Defined Clause in Contracts

Delivery Defined. Delivery of Products occurs when the Purchaser has received the Products either: (a) in the case where the Parties have agreed that Silver Fern Farms will be responsible for transporting the Products to the Purchaser’s nominated destination, at the Purchaser’s destination; or 双方约定由银之蕨负责将产品运输至采购方指定目的地的，该采购方目的地；或 (b) in the case where the Parties have agreed that the Purchaser will be responsible for collecting the Products at Silver Fern Farms’ premises or warehouse or at the port (“Collection Point”) and transporting the Products to the Purchaser’s destination, at the agreed Collection Point. 双方约定由采购方负责在银之蕨经营场所、仓库或港口（“收货地点”）收货并将该产品运输至采购方目的地的，约定的收货地点。
