Delivery Dates. Time is of the Essence. UA’s production schedules are based upon the understanding that Products will be delivered to UA by the date(s) specified in the UA Purchase Order. TIME IS THEREFORE OF THE ESSENCE OF THIS PURCHASE ORDER. If Vendor fails to deliver Products on a timely basis according to the terms of the UA Purchase Order and Agreement, then UA reserves the right to cancel or to purchase replacement Products elsewhere, and to hold Vendor accountable therefor.
