Delegates Facilities Clause Samples
The "Delegates Facilities" clause defines the conditions under which a party may assign or delegate its rights or obligations under an agreement to another entity, often referred to as a delegate. Typically, this clause outlines the process for such delegation, including any required consents or limitations, and may specify which types of obligations can or cannot be delegated. Its core practical function is to provide flexibility for parties to utilize third parties or affiliates in fulfilling contractual duties, while also protecting the interests of the non-delegating party by ensuring oversight and control over who performs key obligations.

Delegates Facilities. 3.9.1 NZQA acknowledges that PSA convenors and delegates have a valuable role in the workplace. Provided that NZQA operational requirements are met, NZQA will:
a. support convenors and delegates to fulfil their role in the workplace;
▇. ▇▇▇▇▇ reasonable paid time to convenors and delegates to carry out their role effectively;
c. allow a reasonable number of paid days to enable convenors and delegates to attend training;
d. allow reasonable use of NZQA facilities to discharge their role (in using these facilities, convenors and delegates will observe NZQA’s normal standards and policies that may apply). The parties acknowledge that NZQA, convenors and delegates work together to help resolve issues at the lowest possible level. This work is often unseen by the convenors and delegates’ team leader and/or manager. NZQA will support convenors and delegates to ensure they are not disadvantaged in any way for carrying out this work. Convenors fulfil a more time demanding role and have greater responsibility across NZQA for PSA work than other PSA elected roles. This may mean that additional time and recognition is appropriate to ensure staff elected to these positions can fulfil their obligations.
