Common use of Delayed Implementation Clause in Contracts

Delayed Implementation. Where due to your failure to deliver and/or perform any Prerequisites: 4.4.1 we are delayed in completing the Implementation Support Services we shall, notwithstanding such delay, be entitled to charge you the Fees in accordance with the dates set out in the Contract Information; and 4.4.2 we are required to undertake Additional Services (including implementation and/or training services) we reserve the right to charge you for such additional services, and we may invoice you for such charges on a time and materials basis in accordance with our then current rates.
