Delaware Trustee May Own Trust Certificates and Notes. Subject to compliance with subsection (a)(4)(i) of Rule 3a-7 of the Investment Company Act of 1940, as amended, the Delaware Trustee in its individual or any other capacity may become the owner or pledgee of Trust Certificates or Notes and may deal with the Depositor, the Issuer Administrator, any other administrator, the Indenture Trustee or any Servicer in transactions with the same rights as it would have if it were not Delaware Trustee.
