DEFAULT IN FCC LICENSE. In the event that the FCC institutes a penalty against or fine imposed on PathNet, Incumbent, or the System, due to non-compliance with any FCC requirements, PathNet shall promptly pay such penalty or fine (in the case such penalty or fine is instituted as the result of an act or omission on the part of PathNet) or Incumbent shall promptly pay such penalty or fine (in the event such penalty or fine is instituted as the result of an act or omission on the part of Incumbent).
