Deduction from Certificate. The Engineer may deduct from any certificate for payment issued under Clause 39.1 such amount as the Engineer shall consider reasonable in respect of any amounts then in dispute between the Purchaser and the Contractor, any deduction as authorised under this Contract and any work or Plant or goods or materials: (a) which in the opinion of the Engineer does not comply with the Contract; or (b) in respect of which the Contractor has not submitted satisfactory evidence.
