Decision to be Made. This Draft EA has been prepared to analyze the impacts on the quality of the environment and other potentially affected resources from implementation of the 2020 DSL CCAA and issuance of a Section 10(a)(1)(A) Permit to the Applicant for activities covered by the 2020 DSL CCAA. The Service must evaluate the 2020 DSL CCAA and Permit application to determine if they meet the Service’s issuance criteria (50 CFR 13.21, 50 CFR 17.22(d)(2), 50 CFR 17.32(d)(2)). The Service must find that
1) the take would be incidental to an otherwise lawful activity and would be in accordance with the terms of the 2020 DSL CCAA;
2) the implementation of the terms of the 2020 DSL CCAA is reasonably expected to provide a net conservation benefit to the affected covered species by contributing to the conservation of the species included in the permit, and the 2020 DSL CCAA otherwise complies with the CCAA policy available from the Service;
3) the probable direct and indirect effect of any authorized take would not appreciably reduce the likelihood of survival and recovery in the wild of any species;
4) implementation of the terms of the 2020 DSL CCAA is consistent with applicable Federal, State, and Tribal laws and regulations; 5) implementation of the terms of the 2020 DSL CCAA would not be in conflict with any ongoing conservation programs for species covered by the permit; and
Decision to be Made. The BLM will decide whether to hold a competitive lease sale for the federal coal reserves within the tract, either in whole (as under Alternative B) or in part (as under Alternative C) , and if leased, under what terms, conditions, and stipulations.
