Common use of Debt Incurrence Clause in Contracts

Debt Incurrence. For purposes of this Section 9.4, Senior Secured Debt shall be deemed “incurred” upon (i) the execution of the Senior Secured Debt Instruments in respect thereof and the satisfaction or waiver of the conditions precedent thereunder to the initial disbursement thereof or initial issuance of letters of credit thereunder or (ii) any subsequent Economic Terms Modification.

For purposes of this Section 9.48.4, Senior Secured Debt shall be deemed “incurred” upon (i) at the election of the Borrower, either (A) the execution of the Senior Secured Debt Instruments in respect thereof and or (B) upon the satisfaction or waiver of the conditions precedent thereunder to the initial disbursement thereof or initial issuance of letters of credit thereunder or and (ii) any subsequent Economic Terms Modification.
