DEBARTMENT CERTIFICATION. Novartis and/or its Affiliate hereby represent and warrant that neither Novartis nor any person employed by Novartis and/or its Affiliates in connection with any work to be performed for or on behalf of Unigene has been debarred under Section 306(a) or (b) of the Federal Food, Drug and Cosmetic Act, and that no debarred person will in the future be employed by Novartis and/or its Affiliates in connection with any work to be performed for or on behalf of Unigene. If at any time after execution of this Agreement, Novartis becomes aware that Novartis or any person employed by Novartis in connection with any work to be performed for or on behalf of Unigene shall become or shall be in the process of being debarred, Novartis hereby agrees to so notify Unigene at once.
