Common use of De-identified Information Clause in Contracts

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to and permitted in writing by the Covered Entity, and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) and meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) ), and the de-identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS).

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to and permitted in writing by the Covered Entity, and (ii) the de-identification is in compliance with 45 C.F.R. CFR §164.502(d); and (ii) and the de-identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. CFR §164.514(a) and (b) and guidance issued thereafter by HHS).

Business Associate may use and disclose de-de- identified health information information, if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-de- identification is in compliance with 45 C.F.R. §164.502(d) ), and the de- identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHStogether with any other component of the Privacy Rule.

Business Associate may use and disclose de-identified deidentified health information information, if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-identification deidentification is in compliance with 45 C.F.R. §164.502(d) ), and the deidentified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHStogether with any other component of the Privacy Rule.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to the Plan and permitted in writing by the Covered Entity, law and (ii) the de-de- identification is in compliance with 45 C.F.R. CFR §164.502(d) and (iii) the de-identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. CFR §164.514(a) and (b) and guidance issued thereafter by HHS).

De-identified Information. Business Associate may use and disclose de-identify Protected Health Information (“De- identified health information if (i) the intended use is disclosed to and permitted in writing by the Covered EntityInformation”), and (ii) provided that the de-identification is in compliance with 45 C.F.R. §164.502(d) ), and any such De-identified Information meets the standard and implementation specifications for de-de- identification under 45 C.F.R. CFR §164.514(a) and or (b) and guidance issued thereafter by HHS). Business Associate may use De-identified Information for any purpose.

De-identified Information. Business Associate may use and disclose de-de- identified health information if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) ), and the de-identified health information meets the standard and implementation specifications for de-de- identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS).

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to and permitted in writing by the Covered Entity, Entity and (ii) the de-de- identification is in compliance with 45 C.F.R. §164.502(d) h164.502(d), and the de-identified health information meets the standard and implementation specifications for de-de- identification under 45 C.F.R. §164.514(a9164.514(a) and (b) and guidance issued thereafter by HHSthe dates of birth and zip codes of individuals in the de-identified population are also excluded.

De-identified Information. Business Associate may use and disclose de-identified health information information, if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-identification is in isin compliance with 45 C.F.R. §164.502(d) ), and the de-identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHStogether with any other component of the Privacy Rule.

De-identified Information. Business Associate may use and or disclose protected health information that has been de-identified health information if (i) in accordance with the intended use is disclosed to and permitted in writing by the Covered Entity, and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) and meets the standard and implementation specifications for de-identification under standards set forth at 45 C.F.R. §164.514(a) ), (b), and (b) and guidance issued thereafter by HHSc ).

De-identified Information. Business Associate may use and disclose de-identified health information information, if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entityits sole discretion, and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) ), and the de- identified health information meets the standard and implementation specifications for de-de- identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS).

De-identified Information. Business Associate may use and disclose de-de- identified health information information, if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-de- identification is in compliance with 45 C.F.R. §164.502(d) ), and the de- identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS).

Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to Covered Entity and permitted by Covered Entity in writing by the Covered Entity, its sole discretion and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) ), and the de-identified health information meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHSthe dates of birth and zip codes of individuals in the de-identified population are also excluded.

Business Associate may use Use and disclose Disclose de-identified health information information, if (i) the intended use is disclosed to and permitted in writing by the Covered Entity, and (ii) the de-identification is in compliance with 45 C.F.R. §CFR 164.502(d) ), and the de- identified health information meets the standard and implementation specifications for de-de- identification under 45 C.F.R. §CFR 164.514(a) and (b) ), as well as the Guidance on De-Identification of PHI issued by the Secretary on November 26, 2012, and guidance issued thereafter by HHSany updates to such guidance.

De-identified Information. Business Associate may use and disclose de-identified health information if (i) the intended use is disclosed to for the proper internal management and permitted in writing by the Covered Entityadministration of Business Associate, and (ii) the de-identification is in compliance with 45 C.F.R. §164.502(d) and meets the standard and implementation specifications for de-identification under 45 C.F.R. §164.514(a) and (b) and guidance issued thereafter by HHS.

De-identified Information. Business Associate may use and disclose de-identified de‐identified health information if (i) the intended use is disclosed to Covered Entity in writing and permitted in writing by the Covered Entity, Entity in its sole discretion and (ii) the de-identification de‐identification is in compliance with 45 C.F.R. CFR §164.502(d) ), and the de‐identified health information meets the standard and implementation specifications for de-identification de‐identification under 45 C.F.R. CRF §164.514(a) and (b) and guidance issued thereafter by HHS).
