DATA SHARING AGREEMENT. A Data Sharing Agreement is identified as a promising practice mechanism for building and participating in an effective research partnership (Xxxxx & Xxxx, 2009). A data sharing agreement should supplement and not supplant an overall data management plan. However if both are completed, they will share several elements. Developing a data sharing agreement is about relationship building, trust building, good communication, compromise, long term planning and finding ways to openly and safely share and maximize the use of the hard earned data from a research partnership. It is about determining culturally and ethically appropriate ways to disseminate the data, meeting funding requirements, improving health outcomes, and adding to the body of scientific knowledge. These are not small tasks, and there are many tools available for partnerships that want to embark on this process. Successful data sharing agreements in community-academic partnerships have three main elements: 1) strong partnership with clear communication; 2) clear process; and 3) well- developed content. The following are best practice recommendations in each of these elements for developing a data sharing agreement.
DATA SHARING AGREEMENT. Intermediary will enter into separate data sharing agreement(s) (“Data Sharing Agreements”) with (a) NYSDOL in a form consistent with NYSDOL’s past practice, (b) with the USDOL Independent Evaluator and/or the Validator and/or the Service Provider, and (c) with other New York or Federal agencies as applicable to the extent required by such entity as a condition to providing information requested by Intermediary in connection with the Project and/or the USDOL Project and/or as required by the Grant in accordance with applicable law. NYSDOL will be responsible for DOCCS compliance with the MOU referenced in Section 5.2(d) and will use its best efforts to cause other New York State agencies to furnish data required for Intermediary to perform hereunder or the Validator to perform under the Validator Agreement, as needed and subject to any applicable data sharing agreement. Intermediary and DOCCS have entered into a Nondisclosure Agreement in the form attached hereto as Exhibit C. Upon prior written notice from NYSDOL, Intermediary will provide, and will require the Service Provider to provide, promptly, but in any event within 20 calendar days, data required for NYSDOL to satisfy Grant reporting requirements. Upon prior written notice from NYSDOL, Intermediary further agrees that it will make available, and will require the Service Provider to make available to the USDOL Independent Evaluator, promptly, but in any event within 20 calendar days, data and documents, including access to program operating personnel and participants, as specified by the USDOL and in accordance with any guidelines provided. Intermediary acknowledges that its obligation to cooperate with the USDOL Independent Evaluator shall survive expiration of the Grant.

DATA SHARING AGREEMENT. This agreement requires the sharing of confidential data protected by the Family Educational Rights and Privacy Act (FERPA) with ASU, a FERPA permitted entity, conducting an evaluation and audit of AzEIP’s equity practices. Prior to commencing any analysis, a written data sharing agreement shall be required between AzEIP and ASU. As part of the key milestones, the ASU Children’s Equity Project shall review sample reports to identify the fields on AzEIP’s reports that will be needed for their analysis. The AzEIP Data Manager or designee will provide a draft data sharing agreement to ASU within two (2) weeks of this fully executed agreement. ASU will provide any necessary feedback to the drafted data sharing agreement including the list of fields needed within two (2) weeks. ASU and ADES shall have the identified signatories sign the final draft within two (2) weeks from the date it is provided.
