Data Return and Destruction of Data. (a) Protecting PII from unauthorized access and disclosure is of the utmost importance to the EA, Contractor agrees that it is prohibited from retaining PII or continued access to PII or any copy, summary or extract of PII, on any storage medium (including, without limitation, in secure data centers and/or cloud-based facilities) whatsoever beyond the period prescribed by this agreement, or as expressly requested by the EA for purposes of facilitating the transfer of PII to the EA or expressly required by law. The EA may use the administrator portal to delete PII at any time or may request assistance from Contractor to do so. If not deleted by the EA, Contractor will automatically delete all PII from its servers after a period of no more than two (2) years following termination of the subscription, and from all backup servers after two (2) additional weeks.
