Data Protection and Back-up Sample Clauses
The Data Protection and Back-up clause establishes the obligations of parties to safeguard sensitive or personal data and to maintain regular back-ups of such information. Typically, this clause requires the implementation of appropriate security measures to prevent unauthorized access, loss, or corruption of data, and mandates periodic back-ups to ensure data can be restored in case of system failures or breaches. Its core function is to minimize the risk of data loss and ensure business continuity, thereby protecting both parties from the consequences of data breaches or accidental deletions.
Data Protection and Back-up a. If Customer exposes Licensor to an individual's Protected Data, Licensor will process and store such information pursuant to Licensor's Security Policies, Practices and Processes found at ▇▇▇▇▇://▇▇▇▇▇.▇▇▇▇▇.▇▇▇/posts/2301934-tibco-security-guidelines. If the European Union's General Data Protection Regulation (EU/2016/679) (GDPR) applies to Protected Data that Licensor processes on behalf of Customer as a data processor, then the Licensor's Data Processing terms at ▇▇▇▇▇://▇▇▇▇▇.▇▇▇▇▇.▇▇▇/posts/3309971-tibco-data-processing-agreement apply to such Protected Data.
b. Except when Licensor stores Customer data in connection with the delivery of a Cloud Service, Customer is responsible for backing-up its data and under no circumstances is Licensor responsible for the protection, loss, destruction, or maintenance of Customer's data.

c) Customer must process personal data in compliance with all applicable laws, including any law requiring a third party’s consent to process personal data.
d) Supplemental Privacy Policy Terms for TIBCO GatherSmart™: End user’s answers to questions posed in TIBCO GatherSmart™ are processed by TIBCO Software Inc. and/or TIBCO Affiliates on servers running on Amazon Web Services. Answers are stored in the browser cache on users devices, but are not stored on the Amazon Web Services servers. Only name and/or user identification information, along with the determination of permission to enter certain premises are stored by Licensor on servers running on Amazon Web Services.
