Daily Work. The Arrangement shall include a Bilateral Evaluation and Dispute Resolution Office for each Party. (a) For the United States, the Bilateral Evaluation and Dispute Resolution Office shall be headed by a designated Deputy United States Trade Representative. For China, the Bilateral Evaluation and Dispute Resolution Office shall be headed by a designated Vice Minister under the designated Vice Premier. (b) Each Party shall designate an official (the “designated official”) to assist in the work of the Arrangement. By the date of entry into force of this Agreement, each Party shall provide the contact information of its respective designated official. Each Party shall update such information as necessary. (c) The Bilateral Evaluation and Dispute Resolution Offices shall (a) assess specific issues relating to implementation of this Agreement, (b) receive complaints regarding implementation submitted by either Party, and (c) attempt to resolve disputes through consultations. In carrying out its work, each Bilateral Evaluation and Dispute Resolution Office may consult with government agencies with relevant expertise.

Daily Work. The employer shall maintain an itemized board with driving assignments other than trips, on a daily basis. In the event there are vacancies due to a driver’s absence for personal reasons or conflict with other driving responsibilities, those vacancies will be filled by other union drivers through the regular bidding procedure. It is the driver’s responsibility to check the board daily and sign for unfilled positions by day’s end prior to the day of a vacancy. In the event there is a last minute vacancy the day of due to an unscheduled absence or cancelled trip, drivers must sign by 9:30 a.m. If a driver signs to fill a last minute vacancy and is bumped after they leave, it is the employer’s responsibility to notify the driver. If not notified, the driver will receive 1 hour show up time if they return for the assignment. If a driver is off work, they have until 9:30 a.m. to call in and bid on any daily work unfilled for the next day. Work will be awarded by seniority. If no union driver can perform the work, substitute drivers can bid on the work. If no subs are available, work will be assigned on the basis of rotating reverse seniority list. Daily Work can consist of but not limited to, regular A.M. and P.M. Routes, Mid-Day Early Shells, Detention, Home Ec, Bowling, After School Sports Route, Special ED Activities off campus, Hope Center, and Bus Evacuations.

Daily Work. If it is necessary to adopt the daywork method, the supervisor shall, after the consent of the employer, notify the contractor to implement the corresponding work on a daywork pricing basis, and the price shall be calculated based on the daywork pricing items and their unit prices included in the priced bill of quantities or budget; if there is no corresponding daywork unit price in the priced bill of quantities or budget, the daywork unit price shall be determined by the parties to the contract in accordance with Article 4.4 [Agreed or Determined] based on the principle of reasonable cost and profit composition . For any work priced on a daily basis, the contractor shall submit the following reports and relevant vouchers to the supervisor for review every day during the implementation of the work: ( 1 ) Name, content and quantity of work; ( 2 ) The names, specialties, types of work, levels and working hours of all personnel involved in the work; ( 3 ) the types and quantities of materials used in the work; ( 4 ) The type, number and hours of construction equipment used in the work; ( 5 ) Other relevant information and certificates. The daily wages are summarized by the contractor and included in the latest progress payment application form, which is reviewed by the supervisor and included in the progress payment after approval by the employer.
