Common use of CYBER ESSENTIALS SCHEME CONDITION Clause in Contracts

CYBER ESSENTIALS SCHEME CONDITION. 5.1 Where the Authority has notified the Supplier that the award of this Contract is conditional upon receipt of a valid Cyber Essentials Scheme Basic Certificate or Cyber Essentials Scheme Plus Certificate or equivalent, then on or prior to the execution of this Contract, as a condition for the award of this Contract, the Supplier shall deliver to the Authority evidence of the same. 5.2 Where the Supplier continues to Process Cyber Essentials Scheme Data during the Contract Period the Supplier shall deliver to the Authority evidence of renewal of a valid Cyber Essentials Scheme Basic Certificate or Cyber Essentials Scheme Plus Certificate or equivalent on each anniversary of the first applicable certificate obtained by the Supplier under Clause 5.1. 5.3 Where the Supplier is due to Process Cyber Essentials Scheme Data after the Commencement Date but before the end of the Contract Period, the Supplier shall deliver to the Authority evidence of: 5.3.1 a valid Cyber Essentials Scheme Basic Certificate or Cyber Essentials Scheme Plus Certificate or equivalent (before the Supplier Processes any such Cyber Essentials Scheme Data); and 5.3.2 renewal of a valid Cyber Essentials Scheme Basic Certificate or Cyber Essentials Scheme Plus Certificate or equivalent on each anniversary of the first Cyber Essentials Scheme certificate obtained by the Supplier under Clause 5.3.1. 5.4 In the event that the Supplier fails to comply with Clauses 5.2 or 5.3 (as applicable), the Authority reserves the right to terminate this Contract for material Default.

CYBER ESSENTIALS SCHEME CONDITION. 5.1 9.1 Where the Authority has notified the Supplier that the award of this Contract Framework Agreement is conditional upon receipt of a valid Cyber Essentials Scheme Basic Plus Certificate or Cyber Essentials Essential Scheme Plus Certificate or certificate equivalent, then on or prior to the execution of this Contractthe Framework Agreement, as a condition for the award of this ContractFramework Agreement, the Supplier shall deliver must have delivered to the Authority evidence of the same. 5.2 9.2 Where the Supplier continues to Process Cyber Essentials Scheme Data during the Contract Framework Period or the contract period of any Call Off Agreement the Supplier shall deliver to the Authority evidence of renewal of a valid Cyber Essentials Scheme Basic Plus Certificate or Cyber Essentials Essential Scheme Plus Certificate or certificate equivalent on each anniversary of the first applicable certificate obtained by the Supplier under Clause 5.19.1. 5.3 9.3 Where the Supplier is due to Process Cyber Essentials Scheme Data after the Framework Commencement Date but before the end of the Contract PeriodFramework Period or contract period of the last Call Off Agreement, the Supplier shall deliver to the Authority evidence of: 5.3.1 9.3.1 a valid Cyber Essentials Scheme Basic Certificate or Cyber Essentials Scheme Plus Certificate or Cyber Essential Scheme certificate equivalent (before the Supplier Processes any such Cyber Essentials Scheme Data); and 5.3.2 9.3.2 renewal of a valid Cyber Essentials Scheme Basic Plus Certificate or Cyber Essentials Essential Scheme Plus Certificate or certificate equivalent on each anniversary of the first Cyber Essentials Scheme certificate obtained by the Supplier under Clause 5.3.19.3.1. 5.4 9.4 In the event that the Supplier fails to comply with Clauses 5.2 9.2 or 5.3 9.3 (as applicable), the Authority reserves the right to terminate this Contract Framework Agreement for material Default.
