Customer’s liabilities. 6.1 The Customer shall be fully liable and responsible for all consequences arising from or in connection with the use of the Service and/or access to any information as a result of such use by the Customer or any other person(s) whether or not authorized.
6.2 The Customer will be liable for any loss of funds arising from any unauthorized transaction if the loss occurs before the Customer notifies the Bank that the Customer’s login credentials has been misused, lost or stolen provided that the Bank has received such notification at a time or under circumstances that renders the Bank able to act upon such notification.
6.3 The Customer will be responsible for all losses (including the amount of any transaction carried out without the Customer’s authority) if the Customer has acted with negligence so as to facilitate any unauthorized transaction(s), or if the Customer has acted fraudulently. For the purposes of this, Clause 6.3, negligence shall be deemed to include failure to observe any of the Customer’s security duties referred to in these Terms and Conditions, and the User Guide.
6.4 Customer shall be solely responsible for ensuring that the online system used by him for accessing the Bank’s electronic channel “Al Islami Business Online” is secured from viruses, hacking, bugs, any threats that may disclose the login credentials to un-authorized persons/parties or lead to distorting/altering Customer’s Commands delivered to the Bank through the electronic channel “Al Islami Business Online” and the Customer shall be held responsible and liable for any altered, deleted or duplicated Command made by him through the online portal.
Customer’s liabilities. (a) The liabilities and obligations of the Customer under this clause shall remain in force notwithstanding any act, omission, neglect, event or matter whatsoever, except the full, prompt and complete performance of all the provisions of this clause, including the proper and valid payment of all amounts that may become due to the Bank under this Agreement and until the Bank has been discharged from all its liabilities and obligations under all the SG-i.
(b) Any discharge or release to the Customer and any composition or arrangement which the Customer may effect with the Bank shall be deemed to be made subject to the condition that it will be void if any payment or security which the Bank may previously have received or may thereafter receive is set aside under any applicable law or proves to have been for any reason invalid.
Customer’s liabilities. 3.1 The customer shall give NOTICE documents related to manufacturing, service places, facilities and activities covered by NOTICE’s service scope. All changes occurring in this regard shall be communicated to NOTICE in written.
3.2 The customer sends NOTICE the related documentation and give them access for document examination.
3.3 The customer allows auditors to enter facilities, access system and records as agreed in different stages of services.
3.4 The customer will not conceal from NOTICE any information related to the services.
3.5 In the framework of relevant common specification, standard, regulations and other documents published or accepted by MDCG, the customer is obliged to comply with any kind of written or verbal information and instruction taken from NOTICE for operation of the management system, product conformity assessment, inspection and testing services.
3.6 The customer whose management system or the product related to the management system is certified shall assign one of the personnel for ensuring the implementation and continuity of the established system, provide auditors’ access to all the required areas in working hours, guarantee the provision of all national legislations or special requirements apart from the management system standard.
3.7 Auditors in the training process, observers or guides can accompany NOTICE in the inspections, audits or unplanned visits carried out in the customer’s site. Observer may be there to observe a member of audit/ inspection team, may be an authorized person of customer, accreditation body or the related ministry. Guides are individuals accompanying the audit team for assistance. Any member of the audit team can be assigned as guide. Guide’s responsibilities may include making communications, arranging meetings, organizing site audit, having site safety regulations applied, witnessing the audit on behalf of the customer, or providing the information requested by the auditor.
3.8 The customer is obliged to declare any kind of verbal or written information to NOTICE personnel, TURKAK representatives or authorities of Ministry of Health of Turkey regarding audit or inspection activities while necessary.
3.9 The customer shall inform NOTICE within duration specified in the Certification Agreement of changes in management system or the certified product related to the management system, the company’s system, or products in the certificate scope after certification and changes affecting system’s str...
Customer’s liabilities. 10.1 Unauthorized distribution, sharing and reselling of IPLC bandwidth, wholly or partly, are prohibited.
10.2 Termination of IPLC to Public Telecommunication Networks other than the buyers network at either the local or distant end is prohibited.
10.3 The IPLC Customer will be discouraged to create VPN or apply encryption either by software or hardware. However, for VPN the Customer has to arrange decrypting facility if required by the Regulatory Body or Law Enforcing Agencies of the Govt.
10.4 IPLCs may be terminated on Customer's private leased line network. Customer shall inform the details of terminations.
10.5 The Customer shall not use the IPLC for any purpose or business that is illegal, unlawful, fraudulent, immoral, inappropriate, contrary to the national security, or in any other way not approved or permitted by the License/permit of the Customer.
10.6 The IPLC must not be used for sending any communication, which is of offensive, abusive, indecent, obscene, defamatory or threatening in nature.
10.7 Refilling traffic from one country to another is not permitted.
10.8 If, any type of traffic is detected in IPLC which is illegal or not permitted, the matter may be dealt with by BSCCL and forwarded to the Law Enforcing Agency/Authority of the Govt.
10.9 Use of the IPLC shall not violate any policy, rule or regulation of the Govt.
Customer’s liabilities. 9.1 The Customer shall be liable for compliance with the law, good practice, and the rules of ethical advertising with regard to the content (including the Customer’s services) it delivers for the provision of the Services. The Customer shall be liable for any intellectual property rights, rights of use, and other permits it may require from third parties for the contents it delivers and produces for Generaxion.
9.2 The Customer shall be liable for ensuring that the content it delivers to Generaxion does not infringe any third-party copyrights, trademarks, or any other intellectual property rights. Generaxion shall not be liable for any of the foregoing. If a third party makes a claim against Generaxion in relation to the foregoing, the Customer undertakes to respond to the claim on Generaxion’s behalf and defend Generaxion and take all necessary action to ensure, at its own expense, that Generaxion does not incur any liability for damages or other liability towards the said third party.
9.3 Generaxion shall not have the right or possibility in every case to monitor whether the
9.4 The Customer shall not be entitled to a price reduction or any other recompense for the action referred to in section 9.3. The Customer shall be liable for all costs and damages incurred by Generaxion due to the Customer’s actions in breach of sections 9.1 and 9.2.
9.5 The Customer shall be liable, at its own expense, for the purchase and maintenance of hardware, software, and telecommunications connections required by Generaxion’s Services, as well as for other costs incurred due to the use of Generaxion’s Services. The Customer shall also be liable for ensuring that its hardware, software, and telecommunications connections do not cause loss or damage to Generaxion, its partners, or other users of Generaxion’s Services. The Customer shall be liable, at its own expense, for the compatibility of the hardware, software, and telecommunications connections it uses with the actions taken by Generaxion.
Customer’s liabilities. 6.1 Without prejudice to other liabilities set forth in the present Agreement, EL SITIO will be liable for the following:
a) Using the SERVICE and the EQUIPMENT in conformity with what is established herein. EL SITIO will use the SERVICE to provide services to its customers via dial-up telephone access.
b) Should IMPSAT provide IP addresses necessary for operation of EL SITIO's internal network, the latter must inform IMPSAT what use has been made of them, every time IMPSAT may so request.
c) EL SITIO will exempt IMPSAT from any violation to intellectual property laws, defamation, calumny, and/or any other acts or omissions of EL SITIO, or of any of its customers, which may cause any damages to third parties, through the use of the SERVICE, resulting in liabilities imposed to IMPSAT by any competent court seeking for compensation to such third parties.
d) EL SITIO will explain to its customers the adequate computing structure for use of the SERVICE and for its adequate operation, which involves a personal computer, telephone line and modem. The customer will be solely responsible for the maintenace of such computing structure essential for access to the SERVICE.
e) EL SITIO will comply with all of the laws and regulations applicable to the services under its responsibility, and for obtaining all of the related permits and authorities.
Customer’s liabilities. 6.1 Without prejudice to other liabilities set forth in the present Agreement, MANDIC will be liable for the following:
a) Using the Service and the Equipment in conformity with what is established herein. MANDIC will use the Service to provide services to its customers via dial-up telephone access.
b) Should IMPSAT provide IP addresses necessary for operation of MANDIC's internal network, the latter must inform IMPSAT what use has been made of them, every time IMPSAT may so request.
c) MANDIC will exempt IMPSAT from any violation to intellectual property laws, defamation, calumny, and/or any other acts or omissions of MANDIC, or of any of its customers, which may cause any damages to third parties, through the use of the Service, resulting in liabilities imposed to IMPSAT by any competent court seeking for compensation to such third parties.
d) MANDIC will provide its customers with an adequate computing structure for use of the Service and for its adequate operation, including a personal computer, telephone line, and modem. The customer will be solely responsible for the maintenance of such computing structure essential for access to the Service.
e) MANDIC will comply with all of the laws and regulations applicable to the services under its responsibility, and for obtaining all of the related permits and authorities.
