Customer Data Indemnification. In addition to Section 9.2 in the Agreement, Customer will indemnify, defend, and hold harmless Polygon, and its officers, directors, employees, and Affiliates against all claims, actions, or proceedings arising out of or in connection with, and to the extent caused by Customer’s violation of Section 2 of this Addendum. This Data Processing Addendum (this “DPA”) is incorporated into, and is subject to the terms and conditions of, the Agreement and reflects the Parties’ agreement with regard to the processing of Edge User Data, if applicable. Capitalized terms used in this DPA, but not otherwise defined herein, shall have the same meaning in this DPA as are given to them in the Agreement or Exhibit A. Customer’s signature to the Agreement shall constitute a signature to this DPA and the Standard Contractual Clauses including the annexes and appendices (as applicable). Notwithstanding this DPA, the terms of the Agreement shall remain in full force and effect.
