Curable Deficiencies Sample Clauses
The Curable Deficiencies clause allows a party to correct or remedy certain failures or shortcomings in their performance under a contract within a specified period after being notified of the issue. Typically, this clause outlines the types of deficiencies that can be cured, the process for providing notice, and the timeframe in which the cure must occur—such as allowing a contractor to fix incomplete work within ten days of receiving written notice. Its core practical function is to provide an opportunity to resolve minor breaches or issues before more severe consequences, like termination or penalties, are imposed, thereby promoting fairness and reducing unnecessary disputes.
Curable Deficiencies. Notwithstanding § 3.3 above, prior to the rejection of a Claim Form, the Settlement Administrator shall communicate with the person or entity who submitted the Claim in an effort to remedy any curable deficiencies in the Claim Form.
