Credit Reporting Requests. Within ninety (90) days of the Effective Date, Fifth Third Bank will make the credit reporting requests to the Credit Bureaus contemplated by Section III.C.5 above.
Credit Reporting Requests. Within fourteen (14) calendar days of the Effective Date, Chase will request that the Credit Bureaus delete the tradelines related to information Chase previously furnished on the closed credit card accounts identified by each Class Member who submitted a qualifying Claim Form. a. All Claim Forms must be submitted by the date set by the Court in the Preliminary Approval Order and specified in the Class Notice, unless such deadline is extended by order of the Court. A Claim Form shall be deemed submitted when either (i) the Class Member completes and submits an online Claim Form available at ▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇, or (ii) the Claim Form is posted, if received with a postmark indicated on the envelope and if mailed by first-class mail and addressed in accordance with the instructions thereon. b. Once Chase completes and submits the necessary forms to the Credit Bureaus to request deletion of the tradeline from Chase related to these accounts, Chase’s obligations under this Agreement are fully satisfied in this regard. c. Plaintiffs and Class Counsel acknowledge that the Credit Bureaus are separate entities from Chase. Accordingly, Plaintiffs and Class Counsel acknowledge that Chase cannot guarantee, warrant, or take responsibility for the performance of the Credit Bureaus in changing, suppressing, deleting, or making entries in relation to any credit information. Plaintiffs and Class Counsel represent that they understand the limitations on Chase in this regard and that any action, omission, and/or error by the Credit Bureaus shall not constitute a breach of this Agreement.
