Court Determination. If a final decision by a court having jurisdiction in the matter shall determine that such indemnification is not lawful.
Court Determination. In the event the Contractor is terminated by the County for default pursuant to paragraph “C., 1.” or “C., 2.” and it is subsequently determined by a Court of competent jurisdiction that such termination was without cause, such termination shall thereupon be deemed a Termination for Convenience under paragraph “G.” and the provisions of paragraph “G.” shall apply.
