Court Determination Sample Clauses

Court Determination. In the event the Contractor is terminated by the County for default pursuant to paragraph “C., 1.” or “C., 2.” and it is subsequently determined by a Court of competent jurisdiction that such termination was without cause, such termination shall thereupon be deemed a Termination for Convenience under paragraph “G.” and the provisions of paragraph “G.” shall apply.

Court Determination. An individual is deemed incapacitated if a court of competent jurisdiction has declared the individual to be disabled, incompetent or legally incapacitated.

Court Determination. If the Contract is terminated by the CTA, for default, and it is subsequently determined by a court that such termination was not justified, such termination will be deemed a termination for convenience, effective as of the date the Contractor received the original notice of termination for default, and the provisions applicable to termination for convenience will apply.

Court Determination. The parties hereto agree that, if any court of competent jurisdiction determines that a specified time period, a specified geographical area, a specified business limitation or any other relevant feature of this Section 4.9 is unreasonable, arbitrary or against public policy, then a lesser period of time, geographical area, business limitation or other relevant feature which is determined by such court to be reasonable, not arbitrary and not against public policy may be enforced against the applicable party.
