COUNCIL’S REPRESENTATIVE. 54.1 The Council's Representative shall be the person nominated in writing by the Council from time to time to act in the name of the Council for the purposes of the Agreement. 54.2 The Council's Representative shall have power to issue instructions to CBH on any matter relating to the provision of the Services and CBH shall comply therewith. If any such instruction is a variation of the Business Plans under clause 5 or a variation under clause 57 it shall be subject to the terms thereof. Provided that any delay resulting does not affect the provision of the Services or the discharge of the Council's statutory duties CBH shall be entitled to object to any such instructions which would have the effect of significantly varying the fundamental nature of the Services and the delivery thereof and such objection shall be referred to the Expert pursuant to clause 60.
