Common use of Costs Clause in Contracts

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Parties.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Parties.

Each Party shall be responsible for its own costs incurred during in conducting the arbitration process Arbitration, and for shall share the following costs, if applicable: (1) costs associated with the cost Arbitrator and other costs of the arbitrator chosen by Arbitration equally; provided that the Party Arbitrator shall have the discretion to sit on the three member panel and one half allocate all or any of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Partiesforegoing costs in a different manner.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three three-member arbitration panel and one half of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Parties.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three memberthree-member panel and one panel; or (2) one-thirdone-half of the cost of the third arbitrator chosen; or (2) one half the cost of the single singlethird arbitrator jointly chosen by the PartiesParties.two selected arbitrators or chosen in accordance with the rules of the American Arbitration Association; and/or (3) one-half of the cost of the two arbitrators chosen by the sole arbitrator selected by one Party in the absence of the selection of an arbitrator by the other Party.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by 63 Service Agreement No. 1702 the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties.

Termination.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Parties.)

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three three-member panel and one panel; (2) one-half of the cost of the third arbitrator chosenjointly chosen by the two selected arbitrators or chosen in accordance with the rules of the American Arbitration Association; or and/or (23) one one-half of the cost of the single arbitrator jointly two arbitrators chosen by the Partiessole arbitrator selected by one Party in the absence of the selection of an arbitrator by the other Party.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties.. 58

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1a) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosen; or (2b) one one-half the cost of the single arbitrator jointly chosen by the Parties.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) one-halfof the cost of the single arbitrator jointly chosen by the Parties; or (2) the cost of the arbitrator chosen by the Party to sit on the three three- member panel arbitration panel; and one (3) one-half of the cost of the third arbitrator chosen; or (2) one half the cost of the single arbitrator jointly chosen by the Parties, or chosen by a Partyafter the other Party’s failure to do so, or chosen in accordance with the rules of the American Arbitration Association.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties. Termination. Notwithstanding the provisions of this Article 22, any Party may terminate this Agreement in accordance with its provisions or pursuant to an action at law or equity. The issue of whether such a termination is proper shall not be considered a Dispute hereunder.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost as well as a proportionate share of the arbitrator chosen by the Party to sit on the three member panel and one half costs of the cost of the third arbitrator chosen; any external arbitration or (2) one half the cost of the single arbitrator jointly chosen by the Partiesmediation.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator Arbitrator chosen by the Party to sit on the three three-member panel and one half of the cost of the third arbitrator Arbitrator chosen; , or (2) one half the cost of the single arbitrator Arbitrator jointly chosen by the Parties.

Costs. ‌ Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties.Parties.‌

Costs. Each Party shall be responsible for its own costs incurred during the resolution of any Dispute, including any costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one one-half the cost of the single arbitrator jointly chosen by the Parties.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costsin connection with any informal dispute resolution or arbitration, if applicable: (1) including the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of its Party-appointed arbitrator; provided, however, that the cost of the a third arbitrator chosen; or (2) one half the cost of the a single arbitrator selected jointly chosen by the Parties shall be shared equally by the Parties.

Costs. Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties.. 49

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if applicable: (1) the cost of the arbitrator chosen by the Party to sit on the three member panel and one half of the cost of the third arbitrator chosenpane l; or (2) one half one-third the cost of the single arbitrator jointly chosen by the Parties.

Each Party shall be responsible for its own costs incurred during the arbitration process and for the following costs, if ifas applicable: (1) one-half of the cost of the single arbitrator jointly chosen by the Parties, if a single arbitrator is appointed by the Parties; or (2) the cost of the arbitrator chosen by the Party to sit on the three three-member panel and one half of the cost of the third arbitrator chosenpanel; or (2) one half 2chosen by another arbitrator to sit on the cost panel on behalf of the single Party if the Party fails to make its own selection of an arbitrator jointly chosen under Section 27.2, if a three-member arbitration panel is selected by the Parties.; and
