Costs of the Examinations Clause Samples
The "Costs of the Examinations" clause defines which party is responsible for paying the expenses associated with conducting required examinations, such as inspections, audits, or assessments, under the agreement. Typically, this clause specifies whether the requesting party, the subject of the examination, or both will bear the costs, and may outline any limitations or reimbursement procedures. Costs of the Examinations. The costs of the examinations shall be borne by the SBA. However, in order to remove any incentive for a Company to delay preparations for an examination, the SBA shall be reimbursed by the Company for any examination expenses incurred in addition to the usual and customary costs, which additional expenses were incurred as a result of the Company’s failure, despite proper notice, to be prepared for the examination or as a result of a Company’s failure to provide requested information. All requested information must be complete and accurate.
