Controlled Information. 11.1 This Condition shall apply in addition to and notwithstanding clause 10 or any other confidentiality condition of the Agreement. 11.2 For the purposes of this Condition “Controlled Information” shall mean any information in any written or tangible form which is disclosed to one party by or on behalf of the other party in connection with the Agreement, and which is identified by the legend “Controlled Information” or other approved legend notified to the Agreement or. Controlled Information shall exclude information provided by oral communication.
