Common use of Contributory Liability Clause in Contracts

Contributory Liability. A party's liability for any Loss incurred by the other party arising out of or in connection with this Agreement is reduced to the extent that the Loss is caused or contributed to by that other party.

Contributory Liability. A party's ’s liability for any Loss incurred by the other party arising out of or in connection with under this Agreement is reduced proportionately to the extent that the Loss suffered by the other party is caused by the breach of this Agreement or contributed to by that the negligent act or omission of the other party.
