Contributory Acts Clause Samples
The Contributory Acts clause defines how responsibility is allocated when both parties contribute to a loss or damage. In practice, this clause typically reduces or limits a party’s liability if the other party’s actions or negligence also played a role in causing the harm. For example, if a customer’s improper use of a product contributed to an injury, the manufacturer’s liability may be reduced proportionally. The core function of this clause is to ensure fairness by apportioning liability according to each party’s degree of fault, thereby preventing one party from bearing the full burden of damages when both share responsibility.
Contributory Acts. Neither the parties to this Agreement nor any other individuals, associations or entities will entitled to indemnification under this Agreement if their own wrongful acts or omissions caused or substantially contributed to the injury, damage or liability for which indemnification is sought.
