Common use of CONTRACT CONFIRMATION Clause in Contracts

CONTRACT CONFIRMATION. 5.1 Within ten (10) days from date of receipt of the CONTRACT, SUPPLIER shall sign the CONTRACT and return it to the owner. The copy of the CONTRACT shall be signed by an authorized officer of the company. 5.2 After CONTRACT confirmation/signing, the terms and conditions contained therein take precedence over SUPPLIER's bid conditions and all previous correspondence. 5.3 If after award of CONTRACT, as per article 28 in ATTACHMENT-II the SUPPLIER does not acknowledge receipt of award of order and/or fails to deposit the performance bank guarantee within the time period specified in the CONTRACT, as per Article 30 of ATTACHMENT I, the OWNER reserves the right to cancel the CONTRACT without prejudice to various rights and remedies the owner may be entitled to as per terms and conditions of CONTRACT and without being liable in any manner whatsoever to the SUPPLIER.
