Common use of Continuous Payment Authority Clause in Contracts

Continuous Payment Authority. 12.1 The Driver hereby authorises Drover to collect any amounts for which the Driver is liable under this Agreement by charging a credit or debit card, the details of which have been provided to Drover by the Driver. Making regular collections from the Driver's credit or debit card is called a continuous payment authority. The Driver shall only provide Drover with debit or credit card details for an account which belongs to the Driver and from which the Driver is authorised to make payments. The Driver acknowledges and agrees that Drover uses continuous payment authority to collect Subscription Fees on the Payment Dates and all other sums which are due and payable by the Driver under this Agreement including all the charges and fees set out in the Subscription Booking Form. 12.2 The Driver may amend their continuous payment authority by emailing ▇▇▇▇▇▇▇▇@▇▇▇▇▇▇▇▇▇▇.▇▇▇. Drivers have the ability to change their due date for payment by emailing ▇▇▇▇▇▇▇▇@▇▇▇▇▇▇▇▇▇▇.▇▇▇ to discuss first. 12.3 In the event a payment fails for a Driver due to insufficient funds being available, Drover will attempt to take the payment again on the following day. If such payment fails, Drover will continue to take payment again on the following day whilst continuing to contact the Driver in order to establish the reason for the failure. If the Driver is having difficulties in making the payment, Drover will then suspend the payment attempts and discuss alternative repayment arrangements with the Driver, in line with applicable affordability checks. 12.4 If Drover make reasonable attempts to contact the Driver following the payment failures, but these attempts are still unsuccessful, Drover will retry the payment on the 6th day following the date on which the first payment fails (the Subsequent Payment Attempt). If the Subsequent Payment Attempt fails, Drover will suspend payment attempts again whilst continuing to try and make contact with the Customer to understand their position and the circumstances surrounding the non-payment. If all efforts to contact the Driver fail, or the Driver refuses to engage with Drover, Drover will retry the payment one more time, and then 3 times per week for 3 months. 12.5 Part payment may be sought on a monthly basis from a Driver if a payment plan has been established in line with affordability, our arrears and debt collection procedures. Payment may be sought on a monthly basis from a Driver if a payment plan has been established in line with our arrears and debt collection procedures. 12.6 If Drover are unable to make contact with the Driver and the Driver does not engage with Drover by responding to correspondence or arranging a payment plan, Drover will explain to the Driver that the consequence of their failure to engage with Drover will mean that their debts will continue to accrue and their financial difficulties may worsen. Part payments are subject After a significant period of no contact from the Driver who is assumed to be in financial difficulties Drover will notify the Driver that Drover may initiate legal action to recover the outstanding debt, including a minimum County Court Judgement being taken out against the Driver. 12.7 A significant period will depend on the circumstances of £50any given case and in particular, the length of the Subscription Term under the Subscription Agreement given that some Drivers will enter into very short term hire agreements with Drover and some will be longer fixed term arrangements. Each case will be reviewed by the Credit Risk team.
