Common use of Continued Listing Clause in Contracts

Continued Listing. The common stock of the Company shall be listed on the NASDAQ Capital Market and shall not have been suspended, as of the Closing Date, by the SEC or the NASDAQ Capital Market from trading on the NASDAQ Capital Market nor shall proceedings regarding such suspension by the SEC or the NASDAQ Capital Market have been threatened, as of the Closing Date, either by the SEC or the NASDAQ Capital Market or by falling below the minimum maintenance requirements of the NASDAQ Capital Market.

Continued Listing. The common stock of the Company Common Stock shall be listed on the NASDAQ Capital Market and shall not have been suspended, as of the Subsequent Closing Date, by the SEC or the NASDAQ Capital Market from trading on the NASDAQ Capital Market nor shall proceedings regarding such suspension by the SEC or the NASDAQ Capital Market have been threatened, as of the Subsequent Closing Date, either by the SEC or the NASDAQ Capital Market or by falling below the minimum maintenance requirements of the NASDAQ Capital Market.

The common stock of the Company Common Stock shall be listed on the NASDAQ Capital Market and shall not have been suspended, as of the Initial Closing Date, by the SEC or the NASDAQ Capital Market from trading on the NASDAQ Capital Market nor shall proceedings regarding such suspension by the SEC or the NASDAQ Capital Market have been threatened, as of the Initial Closing Date, either by the SEC or the NASDAQ Capital Market or by falling below nor shall the Company be out of compliance with any of the minimum maintenance requirements of the NASDAQ Capital Market.
