Common use of Continuation of Measures Upon Termination Clause in Contracts

Continuation of Measures Upon Termination. Except as set forth in Section 7.4.5 “Account Status Upon Termination”, Sections 9.1.1 and 9.1.3, Section 10.4 “Permit Suspension, Revocation and Re-Instatement” and Section 10.5 “Early Termination Mitigation”, upon expiration of this Agreement, or in the event this Agreement is terminated, voided or determined for any reason to be unenforceable before the end of its term, then: (1) the District shall continue to implement the last agreed to Measures until the FERC orders otherwise, and (2) the Parties are not restrained in any manner from advocating to the FERC measures to replace the Agreement.
