The "Contested Cases" clause defines the procedures and requirements that apply when a dispute arises between parties regarding the interpretation or enforcement of the agreement. Typically, this clause outlines the steps each party must take to formally contest an issue, such as providing written notice, engaging in negotiation or mediation, and possibly escalating to arbitration or litigation if the dispute remains unresolved. Its core practical function is to establish a clear, orderly process for handling disagreements, thereby reducing uncertainty and helping to prevent conflicts from escalating unnecessarily.
Contested Cases. Biomet also believes that there is good cause to reduce the amounts to be paid on cases that qualify for payments, pursuant to Paragraph 2 of this Settlement Agreement.
